How this is worked out
- Legal fees follow the Solicitors' Remuneration Order 2023 (P.U.(A) 207, in force 15 July 2023): 1.25% on the first RM 500,000 and 1% on the next RM 7,000,000, with a minimum of RM 500. Above RM 7.5 million the fee is negotiable, up to 1% of the excess.
- A developer purchase of residential property uses the reduced Housing Development Act scale: a flat RM 500 up to RM 50,000, then 75%, 70%, 65% and 50% of the ordinary scale as the price rises. This scale cannot be discounted.
- The loan agreement is charged on the amount financed. A charge or assignment document is charged at 10% of the full fee (minimum RM 500, maximum RM 2,000).
- Transfer stamp duty is 1% on the first RM 100,000, 2% on the next RM 400,000, 3% on the next RM 500,000 and 4% above RM 1,000,000. Loan stamp duty is 0.5% of the loan. The Stamp Act charges per RM 100 or RM 1,000 'or part thereof', so the final amount can differ by a few ringgit.
- Service tax of 8% on legal fees (from 1 March 2024) is added only if your law firm is registered. It is not charged on stamp duty or disbursements.
- Disbursements are not fixed by law. Our estimate is RM 2,000 up to RM 500,000, RM 2,500 up to RM 1,500,000 and RM 3,000 above that. Enter your own figure if you have a quotation.
- Foreign buyers, state-specific rates, company purchases, auction and other special cases are not covered.
